PRODUCT LINE CHANGES: RIC-TRONICS, INC. reserves the right to discontinue or make changes in the product offered without prior notice.

INSURANCE: RIC-TRONICS, INC. will include charges for insurance coverage and will add said charges to the invoice for each shipment as required. If the customer elects not to use insurance when required, then the customer will incur all liability for any and all damages or loss due to shipping damage.

DISCLAIMER OF WARRANTY: SELLER, AS A DISTRIBUTOR/IMPORTER WARRANTS ONLY THAT

THE GOODS SOLD HEREUNDER CONFORM TO THE DESCRIPTION OF THE FACE OF THE ACCOMPANYING INVOICE. SELLER MAKES NO REPRESENTATION OR WARRANTY OF ANY  OTHER KIND, EXPRESS OR IMPLIED WITH RESPECT TO THE GOODS, WHETHER AS TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR ANY OTHER MATTER.      Seller will assist Buyer in all claims within the product manufacturer's warranty policy, and will issue replacement product or credit AT RIC-TRONICS, INC.'S SOLE DISCRETION, and only under the following conditions:

1. Notice of defect must be received in writing within thirty (30) days of buyer's receipt of product.

2. Defective product must be returned to RIC-TRONICS, INC., shipping charges prepaid by Buyer.

3. RIC-TRONICS, INC.'s inspection of returned product discloses to our satisfaction that the product was defective in workmanship and/or material at the time of delivery.

4. No returns will be accepted without RIC-TRONICS, INC. prior authorization.

5. No product will be accepted for credit or replacement if damaged, burned-out, leads cut, or otherwise altered in any fashion from its condition when shipped by RIC-TRONICS, INC.

6. All product is sold as commercial grade product unless specifically quoted otherwise.

LIMITATION OF LIABILITY: SELLER'S SOLE LIABILITY FOR ANY AND ALL LOSSES AND   DAMAGES TO BUYER RESULTING FROM ANY CAUSE WHATSOEVER INCLUDING SELLER'S   NEGLIGENCE, ALLEGEDLY DAMAGED, DEFECTIVE OR NON-CONFORMING GOODS, IRRESPECTIVE OR WHETHER SUCH DEFECTS ARE DISCOVERABLE OR LATENT, SHALL BE ONLY AS STATED ABOVE, AND IN NO EVENT SHALL EXCEED THE ELECTION OF THE SELLER TO REPLACE DEFECTIVE, DAMAGED OR NON-CONFORMING GOODS OR ISSUE CREDIT AT RIC-TRONICS, INC.

SELLER'S ACCEPTANCE OF THE ORDER IS EXPRESSLY MADE CONDITIONAL ON BUYER'S ASSENT TO THE TERMS AND CONDITIONS SET FORTH HEREIN, AND SELLER AGREES TO FURNISH THE PRODUCT DESCRIBED HEREIN ONLY UPON THESE TERMS AND CONDITIONS. IT IS EXPRESSLY UNDERSTOOD AND AGREED THAT THESE TERMS AND CONDITIONS SHALL PREVAIL INSOFAR AS THE SAME MAY IN ANY WAY CONFLICT WITH THE TERMS AND CONDITIONS SET FORTH IN BUYER'S ORDER FORM, IF ANY.

DO NOT USE PRODUCTS SOLD BY RIC-TRONICS, INC. AS CRITICAL COMPONENTS IN LIFE SUPPORT DEVICES OR SYSTEMS! PRODUCTS SOLD BY RIC-TRONICS, INC. ARE NOT AUTHORIZED FOR USE AS CRITICAL COMPONENTS IN LIFE SUPPORT DEVICES OR SYSTEMS. A critical component is any life support device or system whose failure to perform can be reasonably expected to cause the failure of the life support device or system, or to affect its safety or effectiveness.

FORCE MAJEURE: RIC-TRONICS, INC. shall have no liability for, and the Buyer shall not be entitled to  terminate orders due to any delay in performance by RIC-TRONICS, INC. due to an act of God, war, (whether or not actually declared), insurrection, sabotage, fire, earthquake, strike, civil disturbance, storm, flood, transportation contingency, shortage of fuel, law or regulation, act or order of any government, agency, or official, act of public enemy or any other cause beyond RIC-TRONICS, INC.'s control. If any such event occurs, RIC-TRONICS, INC. may allocate production and deliveries among all customers.
